Welcome to Chrometopia. These Terms of Service govern your use of our website, chrometopia.xyz, and purchases made through our online store.

By accessing our website or placing an order with Chrometopia, you agree to these Terms of Service.

Nothing in these Terms limits or excludes any mandatory rights you have under Belgian or European Union consumer law.

Throughout these Terms, “Chrometopia”, “we”, “us” and “our” refer to De Beule Sandro, trading as Chrometopia.

2. Scope

These Terms apply to the use of our website and to orders placed through Chrometopia.

Our online store primarily offers physical consumer products, including electronics, accessories and related lifestyle products.

By placing an order, you confirm that you are legally capable of entering into a binding purchase agreement.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs, videos and other information displayed on our website are accurate.

Product appearance may vary slightly due to lighting, photography, screen settings and reasonable manufacturing variations.

Products are offered subject to availability.

4. Prices

Unless stated otherwise, prices displayed on Chrometopia are expressed in euros.

Prices include applicable VAT where required by law.

Any applicable shipping charges will be displayed before the customer completes the order.

The total amount payable will be shown during checkout before the order is confirmed.

We may change our prices at any time. Price changes do not affect orders that have already been accepted.

If an obvious pricing, technical or typographical error occurs, we reserve the right to correct that error and, where legally permitted, cancel the affected order. If payment has already been received for an order that is cancelled, the relevant amount will be refunded.

5. Promotions and Discounts

Chrometopia may occasionally offer discounts, promotional prices, bundles, discount codes or other special offers.

Promotions may be subject to additional conditions communicated with the relevant offer.

Unless expressly stated otherwise, promotional codes cannot be combined.

Any advertised price reduction will be presented in accordance with applicable Belgian and European Union pricing and consumer protection legislation.

Purchasing a product at a discounted or promotional price does not affect the customer’s statutory consumer rights.

6. Orders

By placing an order, you confirm that all information supplied during checkout is accurate and complete.

After placing an order, you will receive an electronic order confirmation at the email address provided during checkout.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:

• suspected fraud or unauthorised payment
• payment failure
• product unavailability
• an obvious pricing or technical error
• incorrect or incomplete customer information
• misuse of promotional offers

Where an order is cancelled after payment has been received, the applicable amount will be refunded.

7. Payment

Available payment methods are displayed during checkout.

Payment must be successfully authorised before an order can be processed.

Payments may be processed through third party payment providers made available through our ecommerce platform.

Customers are responsible for providing accurate payment and billing information.

8. Shipping Destinations

Chrometopia currently ships to the destinations made available during checkout.

Shipping availability may change over time.

The availability of a country or region during checkout does not guarantee that every shipping method is available for every address within that country or region.

9. Shipping Costs

Applicable shipping costs are displayed during checkout before the customer completes the purchase.

Shipping prices may vary according to destination, shipping method, order value and other relevant factors.

Where Chrometopia offers free shipping, eligibility requirements will be displayed on the website or during checkout.

10. Delivery

Estimated delivery times may be displayed during checkout or elsewhere on our website.

Unless expressly guaranteed, delivery periods are estimates.

Delivery may be affected by circumstances such as carrier delays, peak periods, weather conditions, incorrect addresses and other circumstances outside our reasonable control.

This does not affect any mandatory rights the customer has under applicable consumer law concerning delivery.

Where required by applicable law, Chrometopia remains responsible for the goods until they are delivered to the customer or to a third party designated by the customer, other than the carrier.

Customers must provide a complete and accurate delivery address.

If you notice an error in your delivery information after placing an order, contact support@chrometopia.xyz as soon as possible. We cannot guarantee that an address can be changed after an order has entered the fulfilment or shipping process.

11. Right of Withdrawal

Consumers purchasing online within the European Union generally have a statutory right to withdraw from their purchase without providing a reason.

For the purchase of goods, the withdrawal period generally expires 14 calendar days after the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

To exercise the right of withdrawal, the customer must inform Chrometopia of the decision to withdraw through an unequivocal statement before the withdrawal period expires.

After notifying Chrometopia of the withdrawal, the customer must return the goods within the period required by applicable law.

Nothing in these Terms limits any mandatory statutory right of withdrawal.

12. Returns Following Withdrawal

Customers may inspect a product to the extent reasonably necessary to establish its nature, characteristics and functioning.

The customer may be responsible for diminished value resulting from handling the product beyond what is necessary for this purpose, where permitted by applicable law.

Unless Chrometopia has agreed to bear the return costs or applicable law requires otherwise, the direct cost of returning a product following a change of mind is borne by the customer, provided this has been properly communicated before purchase.

Statutory exceptions to the right of withdrawal remain applicable.

13. Refunds Following Withdrawal

Where a consumer validly exercises the statutory right of withdrawal, Chrometopia will reimburse the payments required by applicable law.

Where required by law, this includes the cost of the least expensive standard delivery method offered for the original order. Additional costs resulting from the customer’s choice of a more expensive delivery method do not have to be reimbursed where permitted by law.

Where legally permitted, Chrometopia may withhold reimbursement until the returned goods have been received or until the customer provides evidence that the goods have been sent back, whichever occurs first.

Refunds will generally be made using the same payment method used for the original transaction unless otherwise agreed.

14. Incorrect, Damaged or Defective Products

Please provide your order number and sufficient information to allow us to investigate the issue. We may request photographs or other reasonable evidence where relevant.

A claim concerning a defective or non conforming product is separate from a change of mind return and is subject to the customer’s statutory consumer rights.

15. Legal Guarantee

Consumers purchasing new consumer goods from Chrometopia benefit from the applicable statutory legal guarantee.

Under Belgian consumer law, new consumer goods are generally covered by a two year legal guarantee for lack of conformity.

If a product does not conform to the sales agreement, the customer may be entitled to the remedies provided by applicable law, which may include repair or replacement and, where the relevant legal requirements are satisfied, a price reduction or termination of the sales contract and reimbursement.

The legal guarantee applies independently of any voluntary or commercial warranty that may be offered.

Nothing in these Terms excludes, reduces or replaces the statutory legal guarantee.

16. Proper Use of Products

Products should be used in accordance with their intended purpose and any instructions or safety information supplied with the product.

To the extent permitted by law, Chrometopia is not responsible for damage resulting from misuse, improper handling, unauthorised modification, accidents or use contrary to supplied instructions.

This provision does not limit the customer’s rights concerning defective or non conforming products.

17. Intellectual Property

Unless otherwise indicated, the Chrometopia website and its original content, including its branding, logos, graphics, designs, photographs, videos, text, product presentation and other creative materials, are owned by or licensed to Chrometopia and may be protected by intellectual property laws.

You may not reproduce, distribute, sell, commercially exploit, modify or otherwise use protected Chrometopia content without appropriate permission, except where such use is permitted by law.

18. Acceptable Use

You may not use the Chrometopia website:

• for unlawful or fraudulent purposes
• to interfere with the operation or security of the website
• to introduce viruses, malicious software or harmful code
• to attempt unauthorised access to systems or information
• to infringe intellectual property, privacy or other legal rights
• to collect information about other users unlawfully
• to misuse discounts, promotions or payment systems

We may restrict access where reasonably necessary to protect Chrometopia, our customers, our systems or third parties.

Nothing in this section excludes or limits mandatory consumer rights, statutory product liability, the statutory legal guarantee or any other liability that cannot legally be excluded.

Chrometopia will not be liable for failure or delay in performing an obligation where that failure or delay results from circumstances outside our reasonable control, to the extent permitted by applicable law.

This may include serious disruptions affecting transport, logistics, communications, infrastructure or other essential services.

Mandatory consumer rights remain unaffected.

Unless mandatory law provides otherwise, the Terms applicable to an order are the Terms in effect when the order was placed.

27. Governing Law

These Terms are governed by Belgian law.

If you are a consumer residing in another European Union Member State, this choice of law does not deprive you of mandatory consumer protections that would otherwise apply to you.

Disputes will be handled by the competent courts in accordance with applicable Belgian and European Union jurisdiction and consumer protection rules.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be interpreted or limited only to the extent necessary to make it enforceable where possible.
